Terms & Conditions
Last updated: June 4, 2026
These Terms & Conditions ("Terms") govern your access to and use of Q-Orders (q-orders.com), an online ordering and store-management platform for restaurants, cafés, and food businesses ("the Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
-
Eligibility and acceptance of terms
By registering for, accessing, or using the Service, you confirm that you are at least 18 years old and able to enter into a binding agreement, and that you accept these Terms on behalf of yourself or the business you represent.
If you use the Service on behalf of a business, you confirm that you are authorized to bind that business to these Terms, and "you" refers to that business.
-
Description of the service
Q-Orders lets businesses build an online store, publish a digital menu and catalog, generate QR menus, accept orders and reservations, manage customers, and view analytics. Features available to you depend on the subscription plan you select, and we may add, change, or remove features over time.
-
Account registration
To use most features you must create an account. You are responsible for the accuracy of the information you provide and for all activity that occurs under your account. Keep your credentials confidential, enable available security features, and notify us immediately of any unauthorized use or suspected breach.
-
Business account and store-owner responsibilities
As a business or store owner using the Service, you are solely responsible for your store, its content, and your dealings with your own customers. In particular you are responsible for:
- Operating your business in compliance with all laws, licenses, and regulations that apply to it, including food-safety, consumer-protection, and tax rules.
- The accuracy and lawfulness of the menus, products, prices, descriptions, and images you publish.
- Fulfilling orders and reservations you accept, and handling your customers' enquiries, complaints, refunds, and disputes.
- Obtaining any consents required to collect and use the personal data of your own customers (see the Privacy Policy).
- The acts of staff or team members you invite to your account.
-
Customer orders and storefront usage
The Service provides the technology that lets your customers browse your storefront and place orders or reservations. Each order or reservation is a transaction between you (the business) and your customer. Q-Orders is a technology provider and is not a party to that transaction, is not the seller of any goods, and does not prepare, handle, or deliver food.
-
Product, menu, price, and availability accuracy
You are responsible for keeping your menu items, prices, taxes, availability, and descriptions accurate and up to date. If an item is shown incorrectly or is unavailable, you are responsible for resolving the matter with the customer in line with your own policies and applicable law.
-
QR codes and public storefront links
The Service may generate QR codes and public links to your storefront and menu. You are responsible for how and where you display them, and for ensuring the destination remains accurate. Public storefront links are intended to be shared; do not use them to misrepresent your business or any third party.
-
Subscriptions, plans, billing, and renewals
Paid plans are billed in advance on a recurring basis according to the plan you choose. Plan limits, prices, and features are shown at the time of purchase and may change with reasonable notice. Subscriptions renew automatically for successive periods unless cancelled before the renewal date.
You may upgrade, downgrade, or cancel at any time from your account. Cancellation stops future renewals but does not retroactively refund the current billing period. Downgrading may reduce the limits and features available to you.
-
Payments and third-party payment providers
Subscription fees and, where enabled, customer payments may be processed through third-party payment providers. Your use of those providers is subject to their own terms and privacy policies. We do not store full payment-card numbers; card data is handled by the payment provider. You are responsible for keeping your billing details current and for any fees charged by your payment provider.
-
Taxes, VAT, and invoicing
You are responsible for determining, charging, collecting, reporting, and remitting any taxes, VAT, or duties that apply to your sales to your customers, and for issuing any tax invoices your customers or the authorities require. Any tax settings or amounts the Service helps you configure or display are provided for your convenience and do not constitute tax advice.
Q-Orders does not provide tax, accounting, legal, or e-invoicing compliance advice. You are responsible for ensuring that your invoices, tax settings, VAT treatment, and records comply with the laws and requirements that apply to your business, including any applicable e-invoicing or tax authority requirements. Unless a separate written agreement expressly states otherwise, Q-Orders is not responsible for determining whether your invoices or records comply with VAT, e-invoicing, accounting, or tax obligations.
-
Refunds and cancellations
When you cancel a paid subscription, cancellation prevents future renewals. Unless otherwise stated or required by law, you may continue using the paid features until the end of the current billing period, and fees already paid for the current period are not refunded.
Refunds, returns, and cancellations for orders placed by your customers are governed by your own store policies, which you are responsible for publishing and honoring. Q-Orders does not process refunds between you and your customers.
-
Free trials, promotions, and discounts
We may offer free trials, promotional pricing, or discounts subject to additional terms shown at the time of the offer. We may modify or withdraw such offers, and unless stated otherwise a paid plan begins automatically when a free trial ends.
-
Acceptable use and prohibited activities
You agree not to misuse the Service. In particular, you must not:
- Break the law or infringe the rights of others through your store or content.
- Upload malware, attempt to gain unauthorized access, probe, or disrupt the Service or its infrastructure.
- Sell prohibited, counterfeit, unsafe, or misrepresented goods.
- Use the Service to send spam or unlawful, deceptive, or harmful communications.
- Circumvent usage limits, security controls, or anti-abuse measures.
- Resell, sublicense, reverse-engineer, scrape, or copy the Service without our written permission.
-
Platform security and anti-abuse protection
To protect accounts, forms, and services from spam, fraud, and automated abuse, the Service uses security measures including Google reCAPTCHA. These measures may process technical information such as IP address and browser or device signals to verify that requests come from real users. You must not interfere with or attempt to bypass these protections. See the Privacy Policy for more detail on how this information is handled.
-
Third-party services
The Service integrates with third-party providers such as payment gateways, mapping and location services, email and messaging providers, analytics, hosting, and security/CDN providers. Your use of those services may be governed by their own terms, and we are not responsible for their performance, availability, or policies.
-
Your content and business content
You retain ownership of the menus, media, logos, customer records, and other content you add ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display Your Content solely to operate, secure, and improve the Service. You are responsible for ensuring you have all rights and permissions needed for everything you upload, and that it does not infringe any third party or break the law.
-
Intellectual property and license to use the platform
The Service, including its software, design, branding, and trademarks, is owned by Q-Orders and its licensors. Subject to these Terms and your subscription, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your business. These Terms grant you no other rights in our intellectual property.
-
Data and privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms. Where you collect personal data from your own customers through the Service, you act as the party responsible for that data and must comply with the privacy laws that apply to you.
-
Service availability, maintenance, and updates
We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may perform maintenance, modify or update features, and temporarily suspend access where necessary to protect, secure, or improve the Service, and will aim to limit disruption where reasonably possible.
-
Account suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your account, with or without notice, if you breach these Terms, fail to pay fees, or use the Service in a way that harms us, other users, or third parties, or where required by law. On termination your right to use the Service ends, and we may delete your data after a reasonable period, subject to legal retention requirements.
-
Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that it will meet your specific requirements.
-
Limitation of liability
To the maximum extent permitted by law, Q-Orders is not liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, goodwill, or data, arising from or related to your use of the Service. Our total aggregate liability for any claim is limited to the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
-
Indemnification
You agree to indemnify and hold harmless Q-Orders and its officers, employees, and partners from any claims, damages, losses, liabilities, and reasonable costs (including legal fees) arising from your use of the Service, Your Content, your products and dealings with your customers, or your breach of these Terms or of applicable law.
-
Changes to the service and to these terms
We may add, change, or discontinue parts of the Service. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Continuing to use the Service after changes take effect means you accept the revised Terms.
